Rationalist Vs. Romantics Essay

Intro to Sociology

1. The sociological perspective (imagination) can be characterized as seeing the general in the particular and how the general operation of society affects the experiences of particular people. With that, sociology educates people to better understand the opportunities and the barriers that exist in their lives. Sociological perspective can be a valuable asset in coming to terms with a personal problem. After I had to take medical leave from work and could not return because of a nerve disorder I am currently having, I began to feel as if I was not being constructive enough and my self worth took a nosedive. I was biased against myself for not doing what it is a man is ‘suppose' to be doing in society, even though I am physically hindered right now. During this time off I figured I could take a couple of classes while wait out the pain. As I analyzed the opportunities available for me to attend college full-time such as the GI Bill, loans and grants, I also reassessed some personal and professional goals with my family as in what I should do. I realized I didn't want to work in a factory for 20 years, if or when I recover, so I enrolled in college to better pursue my adjusted goals which include Associates and Bachelor Degrees in Accounting to become a Certified Public Accountant. With this opportunity comes the constraint of being in debt when leaving school but that is s how society is here in America, ‘you have to give a lot to receive a lot'. As I look back at these events, I realize my lack of self worth was a direct result of not living up to what my perception of a man's role in society is and that was causing unnecessary self-inflicted stress. There was no reason to think I was a different person of lesser value just because of my situation, but I know if I did not believe that at that time, I would not be taking this test. This injury has caused changes in statuses such as becoming a college student, becoming unemployed, and physically disabled and performing these roles in society has made me view our society as whole in a much more critical way. The sociological perspective in Jeremy's terms means: Take a step back, think for yourself, process all information, and question the doubts before making decisions that effect your life and the lives around you. . â€Å"Free Will† can be achieved on a constant basis if one decides to accept certain morality standards and values that should be practiced by all mankind. If we accept the world in which we live (laws, rules and all), we will then have the choice or â€Å"Free Will† to make changes, if needed, by running for government or leading protests or being an influential personality such as Dr. Martin Luther King Jr. One could argue, â€Å"we do not have free will because we cant do whatever we want! † If someone wants to injure, even kill someone, or something else that harms, cheats, or steals from another, they should face some kind of consequences for their inhuman acts towards another person. â€Å"Free Will†, as I perceive it, is more abundant in this country than almost anywhere in the world because free will is about having choices and being able to decide what is best for you. Society can greatly influence the appeal of one decision over another and make one the easy choice, or programmed choice, but its here that your choice to follow the easy route, the popular societal choice or to take the road less traveled, unpopular choice is why Free â€Å"Will† exist. These choices in life that society creates are as â€Å"Free will† as it get; without society influencing our lives and the decisions we make in these ways, life would get real plain. Choices are why I believe â€Å"free will† remains, as long I am able make the decisions, that guide my life I will have â€Å"Free Will†. . This video was about a teacher from Iowa and the process she created to tech her 3rd grade students about discrimination in 1968 and their reunion 20 years later. The teacher then later applies the same process at an adult correctional officer workshop that produces similar results as the 3rd graders. The kids were segregated into blue-eyed and brown-eyed people and the teacher discriminated toward the brown-eyes one day by telling them how bad they did everything and then treated the blue-eyes the exact same way the next day. What she found was that her sweet, caring class of 3rd graders were vicious and mean towards the ones being discriminated on within 15 minutes of the prejudices being introduced to the classroom environment. Both group of kids took tests on both days and the results were much worse on the days their particular group was discriminated against and were not happy at all. With that, prejudices have a reactionary effect that seems to degrade the self-esteem and self-worth at once while also altering behavior and attitude.. The blue-eyed adults later in the film started getting agitated, uncooperative, combative, and mean due to the lack of respect they were receiving as a blue-eyed person in the same scenario. This documentary shows prejudices are mostly influenced by the surrounding environment and peers, or a culture of prejudices, which views certain categories as better or worse than others. Even if one does not agree with the prejudice, they might conform to the surrounding prejudices to ‘fit in' and so as not be discriminated against themselves. Other than both the primary and secondary groups influencing the way a person acts, most of each groups characteristics are opposite of each other. The quality of relationships in a primary group is personal orientation while secondary group are more goal orientated. The length of a primary group relationship is usually long term, where secondary groups tend to be short-term, but can vary. The primary group also will be involved in a wide range of activities, and know each other well, while secondary groups tend to involve few activities and have a narrow relationship. The subjective perception of the primary group is â€Å"as an ends in themselves' , while ‘an ends to an end† is the secondary groups perception. My family is my primary group that is involved in my everyday life that ranges from childcare to socializing to arguing. My family being behind me has allowed me to have the confidence and self-esteem to accomplish all that I have and am currently doing and have done in my life such as military service and high school. My mother's continuous positive attitude and smile has always let me know that even if I failed, she loved me no less. No matter the outcome Mom always was proud of the effort, that is all she asks. My stepfather's behavior seems to be those of a saint to me and, despite a few bumps in my road; I strive to walk a similar path as him. Even though he is my Stepfather, this man has raised me for 20 years of my 27 with class, respect, and dignity. The combination of these two great people and their qualities has allowed me to develop the self-concept needed to have a rich and fulfilling life. An example of a secondary group is our class. The impact on my behavior is I am more serious in class since I'm paying for this education and here to learn. I bet no one in this secondary group knows I do a GREAT pigeon impression (on the ground wobbling around and all! ). That would be too interpersonal for this secondary group but not my for my family/primary group, I have proof! My self-concept isn't impacted by this secondary group too radically because being in a new classroom with a bunch of people I never met before is the norm, especially being in the military and after 6 years of it, I am accustom to the environment of the unknown classroom. If anything, this secondary group, our class, has increased my self-esteem since I am more apt to speak out in class than ever before. Being able to experience some real life in the military and then coming to school has been a blessing in disguise because I am such a better student now than ever in high school. In all, despite having opposite characteristics, primary and secondary groups can both have an influential presence in self-concept, self-esteem, and behavior. 9. An ascribed status is a social position a person receives at birth or assumes involuntarily later in life. People usually have little or no choice in this status. Such as a death or disability later in life. An achieved status refers to a position a person assumes voluntarily that reflects personal ability and effort. Some statuses matter more than others such as a master status, which has a special importance for social identity, often shaping a person's entire life. For most in the US, occupation is the master status because it conveys a great deal about social background, education, and income. While a person holds a status, they perform a ROLE, or a behavior expected of someone who holds a particular status. Actual role performance varies according to a person's personality, although some societies permit more individual expression than others. In a modern high-income country, like us, role conflict arises between roles corresponding to two or more statuses, such as parenting, full-time student, and fianci. Even roles linked to one status can cause tension known as role strain. In short, performing these roles required of us requires a balancing act throughout our life. The biggest role conflict in my life is the full-time student with parenting a child with Downs Syndrome and my current physical disability that forced me out of work and normal everyday activities without pain. Being able to analyze each status and what was expected for each role allows me to ‘compartmentalize' my school role so I can better focus on the needs of my family while home in the evening and pain management for myself. In the end compartmentalizing is organizing information in your head as to the environment expected in whatever role is needed at that time and not letting multiple roles conflict and cause something to happen that should not. Romeo and Juliet Balcony Essay

A Tragic Story of Two Lovebirds William Shakespeare’s Romeo and Juliet is a well-known and phenomenal play of tragedy. The reason for its fame is that not only is it just dreadful, but there is also a romantic element as well. The play is set in Verona, Italy during the Elizabethan Age with two young and innocent lovers, Romeo and Juliet, from different wealthy families, Montague and Capulet. However, these two households share a hostile bond with each other that goes deep in Verona’s history.In one of the acts there is the famous â€Å"balcony scene† which takes place at night with Juliet on her balcony and Romeo down at her father’s orchard. While Juliet confesses her private thoughts alone, R omeo describes her stunning beauty and his feelings of love through personification.As Romeo gazes at her, he describes that her cheeks â€Å"would shame those / stars† (2. 2. 19-20). Her looks give off a special radiance that makes him say her cheeks outshine the eternal light given from the stars. By using stars, her beauty gives him hope, light, and a sense of goodness into his existence. This suggests that her brightness gives a certain direction that leads his life in a positive way. Then, Romeo argues that â€Å"stony limits† will not stop his love because â€Å"what love can do, that dares love attempt† (2. 2. 72. 73). Since Romeo is in his lover’s and foe’s house, he does not mind risking his life for her.His action is what a true lover does because an ordinary stranger or friend never bothers doing it. If his feelings are a physical object, it can be so strong that not even hard stone can prevent it. We noticed that most of the work did not match because of differences in referencing. We had to reassign the work for a redo, and this time taking all necessary precautions. Ethical Issues Essay Researchers found that 10 percent of employees at all levels report feeling pressured to compromise ethical standards in the workplace (Managing Business Ethics by Trevino and Nelson 2007). Ethical issues are faced by every industry in the business world as well as communities, public and private organizations and individuals. Leadership, internal practices, and training may impact the proper implementation of business ethics. Halliburton is one of the many large corporations involved in unethical business practices. This paper examines ethical issues faced by public sector employees and employees of private sector firms that conduct business with and for government agencies. The paper discusses Halliburton, a U. S. defense contractor (former vice president Dick Cheney’s old firm), ethical issues and the impact on stakeholders involved. The goal is to highlight the ethical issues and make recommendations for how prospective employees and managers can handle similar situations. Background Since 2001, energy services company Halliburton and its former subsidiary Kellogg Brown Root (KBR) have performed unspecified services to the United States military in Iraq, Kuwait, and several other countries under a no-bid, long-term global logistics contract, (LOGCAP). In February 2003, Halliburton received a five-year extension, $7 billion no-bid contract for services in Iraq. During the course of awarding and executing these contracts at least two people made the decision to become whistle blowers, a government employee, and a Halliburton/KBR procurement employee. The government employee disclosed that Halliburton/KBR was involved in closed-door meetings with the Army Corps of Engineers that resulted in the no-bid, multi-year, billion dollar contract awarded exclusively to Halliburton/KBR (Morning Edition October 29, 2004). The procurement employee disclosed the specific activities within Halliburton/KBR that resulted in overcharging the government and taxpayers for goods and services while simultaneously eliminating competition among potential vendors. Some allegations include soliciting higher priced products and services because the government pays a fee based on the total of goods/services procured and manipulating purchases orders to maintain a maximum of $2,500 to avoid the bidding process between prospective vendors. Specifically, Halliburtons subsidiary Kellogg, Brown Root hired a Kuwaiti company, Altanmia, to supply fuel at about twice the going rate, then added a markup, for an overcharge of at least $61 million, according to a December 2003 Pentagon audit. The only problem is that $61 million is taxpayer money. Perception of Unethical Practices of Dick Cheney From the beginning many American citizens raised an eyebrow towards the decision to have Halliburton as a U. S defense contractor. This public outrage stemmed from the former vice president’s former employment as the chief executive officer (CEO) of Halliburton from 1995 through August 2000. KBR, the companys former subsidiary has been the main government contractor working to restore Iraqs oil industry that was awarded without competitive bidding in 2001. According to Cheneys 2001 financial disclosure report, the vice presidents Halliburton benefits included three batches of stock options comprising 433,333 shares. He also has a 401(k) retirement account valued at between $1,001 and $15,000 dollars. His deferred compensation account was valued at between $500,000 and $1 million, and generated income of $50,000 to $100,000. Halliburton has contracts worth more than $1. 7 billion for its work in Iraq, and it could make hundreds of millions more from a no-bid contract. During Cheney’s tenure as the defense secretary, the Pentagon chose Halliburton’s subsidiary KBR to study the cost effectiveness of outsourcing some military operations to private contractors. Based on the results of the study, the Pentagon hired KBR to implement an outsourcing plan (Washington Post Sep 26, 2003). Many companies like Bechtel, Exxon, Blackwater and Halliburton have profited from the Iraq war. It is no secret that war creates wealth for those companies canny enough to exploit it, and not be killed by it. Is Dick Cheney one of these? After his departure from office former vice president Cheney will be free to profit in whatever way he feels. The ethical question is, however, has he ever really left it? And by not leaving it, was he in ethical violation of his oath of office, at the very least? Stakeholders The stakeholders in this situation are the client, which is the U. S. government and American taxpayers who are the investors or funders of the government; the vendors, who through the bidding process maintain a competitive and profitable business environment; and employees who make sure that their employers receive the best value for the services and products they procure. Ethical dilemmas The first ethical dilemmas is if employees should bring wrongdoing to the surface and if so, how? Will the decision violate the privacy of vendors or other employees? Is it legal to disclose certain activities related to defense contracts? Secondary ethical issues relate directly to the stakeholders. Is the U. S. government unfairly awarding contracts? Is that awarding process facilitating a culture of overcharging, which is absorbed by U. S. taxpayers? Are vendors intentionally overcharging Halliburton/KBR? Are Halliburton/KBR’s procurement practices eliminating competition in the marketplace? Analysis The primary issue in this situation is whistle blowing. â€Å"Whistle blowing means calling attention to wrongdoing that is occurring within an organization. †(Nadler and Schulman 2006) Halliburton is still under investigation by the FBI. Perhaps the negative publicity and the case caused the contract to be divided with Halliburton winning one of the parts in a public bid. The underlying secondary issues include exposing potentially fraudulent business activities, financial irresponsibility, and illegally profiting from public funding. The government employee wrote and spoke to superiors about the activities. The government employee sought legal counsel upon deciding to go public with their disclosure. Finally, both made their testimonies to the proper investigating bodies including the FBI, the U. S. House of Representatives Committees on Government Reform and Energy and Commerce. For their troubles, the government employee and Halliburton/KBR procurement employee were forced into a whistle-blowers protection program. Conclusion In the public sector, whistle blowers are often faced with the dilemma that their choice to disclose can constitute a criminal act. In both cases these employees called attention to suspected activities within their organizations before going outside or public. Employees faced with this dilemma must identify the stakeholders and ethical issues that concern them, and then make calculated decision whether or not to disclose. The facts surrounding whether or not the U. S. government are unfairly awarding contracts will be an ongoing issue. Despite all the measures set forth to regulate the procurement of contracts, greed for money will play a critical factor for the people that have weak ethical character. Whether you are the employee or employer being the standard bearer in ethical situations will earn the respect of others as well as keeping you out of big trouble. The Analysis of â€Å"Loser-hero† Essay In the book â€Å"Warriors of Japan as Portrayed in the War Tales†, as the title suggests, author Paul Varley studies numerous war tales from hundreds of years of Japanese history, throughout the rise of the samurai warrior culture and the societal change that went along with it. From ancient war tales like the Shomonki to tales firmly in the medieval times like the Taiheiki, the changes in battlefield customs and warrior society are presented and studied as they change and evolve. Despite all the social changes occurring in these time periods, a certain element stays the same throughout all these tales, the warriors themselves. The main focus of nearly all these war tales follows the rise and equally the fall of esteemed warriors of the period. The tales also touch on time honored values and beliefs such as honor, respect and reputation frequently. The evolution and prevalence of these values influences the way of life of the warriors in the tales, on and off the battlefield. Varley goes one step further to separate warriors into distinct, classic categorizes, based upon their characteristics and actions. There are three archetypes: loser-hero, tragic loser-hero, and failed loyalist hero, with almost all warriors discussed in the book fitting into one group or another. Why would Paul Varley put such emphasis of the three archetypes of heroes in Japanese history? The explanation is found in the analysis of the characters themselves, and noticing the fact that they continually come up in Japanese literature. In order to better understand the usefulness of the three main archetypes in Japanese history, it would be prudent to first start with the definition and analysis of the characters themselves. The first archetype to appear in â€Å"Warriors of Japan† is the loser-hero, a good example of which can be found in the tale of Minamoto no Tametoto. Tametoto is particularly special in that he is a loser-hero but not a tragic loser-hero, as the two are very similar and easily connected. The Hogen Monogatari tales recount the story of the Hogen Rebellion, which the feared and treasured warrior Tametoto fought in. By most accounts, although most likely fictionalized for the sake of storytelling, Tametoto was a fierce and ruthless soldier, whose skills with a bow impressed any who witnessed them. From his extensive experience in war, Tametoto has seen the success that a night attack can bring, and believes that it is the best way to defeat the opposition in this conflict, the Sutoku. He argues to his comrades that if they do not use this strategy on the enemy, the enemy will use it on them. His advice is rejected by the Fujiwara leader Yorinaga, and the enemy does indeed attack that night. The Fujiwara and Minamoto base at the Shirakawa Palace is defended valiantly by Tametoto, but with few reinforcements is basically fighting by himself. At one point it seems that Tametoto is actually winning the fight, at least until the Sutoku side sets the palace on fire, forcing Tametoto to flee the palace where he is captured by the enemy. In this story, Tametoto is a loser hero because it is not his fault that he is defeated, his effort was fantastic and it was the faults of others, namely Yorinaga, that lead to his defeat. Paul Varley defines the tragic loser-hero as â€Å"One who fails or comes to grief at least in part because of some weakness or flaw of his own-he is not done in entirely by others or by outside forces-and whose end if made especially moving because his reduced state evokes memories of an earlier time of fame and glory† (Varley, 57). Some defining traits of a tragic loser-hero are that he is always aided by an ever-faithful follower who is always at his side, and that his indecision and inactivity in his last moments leads to his defeat. Minamoto no Yoshitsune from the Heike Monogatari tales is a perfect example of the classic tragic loser-hero. Though a â€Å"vigorous commander†, Yoshitsune eventually fails because of his â€Å"political ineptitude† and â€Å"his rash handling of Kajiwara no Kagetoki† (Varley, 155). One thing that makes tragic loser heroes so interesting is that they are often rather relatable; they have flaws that in their character, they make bad decisions and lose their temper. This evokes a sense of sympathy in the reader, and this underdog characteristic lends well to fictionalized tales and song celebrating the warrior spirit. There are many tragic loser-heroes throughout the war tales studied in â€Å"Warrior of Japan†, because it is an important archetype that has its place in Japanese literature. The last specific subtype of hero we are going to explore is the Failed Loyalist Hero. This hero is generally characterized by his self-sacrificing loyalty, specifically his unswerving devotion to Emperor Godaigo and the southern court. This loyalty is usually what leads to the hero’s eventual death in battle. Readers take an interest in the extreme self-sacrificing loyalty displayed by these characters; loyalty is explained in â€Å"Warriors of Japan† as a highly respected virtue in Japanese history and literature. The failed loyalist is different from the other types of heroes in that these type of characters do not become prominent until the Taiheiki, where warriors become way more ingrained with imperial loyalism. Before this period, a lot of warriors do have devotion to their commanders and emperor, but not to the extent that they could be considered a failed loyalist hero. Now that the archetypes are defined and their differences detailed, it would be useful to also explore their similarities, of which there are many. Most notably, the only difference between a loser-hero and a tragic loser-hero is that a tragic loser-hero’s defeat is the result of a personal flaw. While sometime this distinction often clearly separates a loser from a tragic-loser hero, the commonalities often lead to a character becoming both archetypes. The failed loyalist hero, however, does not have as many parallels to the other types, but there are still some shared traits. Still a superb warrior, the failed loyalist follows the warrior lifestyle and the battlefield customs of the time. Also, the amount of loyalty that character possesses is no unlike the tragic-loser and loser heroes, it’s just that the failed loyalist hero is loyal to the point where that trait brings on his downfall. So in conclusion, all the hero archetypes may be distinctly separated, but generally share a few traits at the least, showing a clear theme of the warrior culture of the time. A theme that contains ideals like devotion, respect, loyalty, bravery, and honor. The only issue left to address would be that of why author Paul Varley would take interest to stressing the different archetypes of heroes, and feel the discussion of them it imperative to the study of Japanese literary war tales. The best explanation of it may have been said by the author himself, as he writes, â€Å"Firstly, there is a distinct liking in Japanese literature, discernible in the earliest writings, for stories of the sufferings and tragic fates of those who lose out in particular events or affairs† (Varley, 56). Varley understands that dramatic characters are important to Japanese literature, and as such strives to maintain that element of the literature by examining the hero archetypes, which are inherently tragic and sometimes contain suffering. The often fictionalized and embellished stories of the warriors indicated that something about Japanese culture at the time enjoyed a good story, often for reasons other than the basic factual details of what took place. A great illustration of this is the often embellished story of loser-hero Tametoto, because while based on a real person, through the retellings of his story his character was often greatly exaggerated and propelled to mythical levels. He went from being a regular, even exceptional warrior in real life to a â€Å"veritable superman† and â€Å"a monster† in the war tales (Varley, 56). This evolution of Tametoto’s character, and other characters throughout Japanese history, suggests an affinity in Japanese culture and literature for theatrical and compelling narratives. Much speculation can be made about why this is, but the main intent of this study is the compelling conclusion that Paul Varley decided to stress the three archetypes of heroes discussed because of their inherent importance and presence in Japanese history, literature, and culture. In this unit we have discussed the different definitions and models of change which have been given by thinkers in the past which helps in evaluating the relevance of models of strategic change to organizations in the current economy. As we proceed, we examine the need for change and assess the factors that are driving the need for it. Also, the resource implications are discussed which do not respond to strategic change. The theories given by Kotter, Prosci, Lewis and others are milestones of the research on change management. Their theories have helped in thorough understanding of change management. As the topic develops, it gives vital information on the reasons of change in markets, budget pressures, new technologies and other new programs such as TQM and re-engineering. All in all, the topic is an important resource on the factors and implications that bring change. Another unavoidable and inseparable resource of the organization is stakeholders of the company. The topic discusses about systems modelling, divergence and convergence and methods of involving them into organization. Technological advances There has been drastic change in production, marketing, outsourcing and other fields due to technology. The organization needs upgrading and has to keep in pace with the technological advances to succeed in its mission and make way for growth. Keeping in mind the factors discussed above, there is a need for change. Funding cuts With the recession in the economy, the company has cut down on costs and funds. There is need for change in financial strategy to keep the balance. Competition Competition is a healthy asset for any business. â€Å"Crimean history would suggest that it is folly to think that possession of any place, especially paradise, is anything other than a tenancy (Newman, 2011).Crimea may be compared to paradise, the crowning glory of many an empire, and it is no wonder with its subtropical climate, fertile lands, soft meadows and sprawling coastline. But the very aspects that make an Eden out of the Crimean Peninsula have also been the causes of struggle and conflict. For it may be said that Crimea is a contested land in an identity crisis and is the subject of much debate still today. Divided by conflicting ethnicities, passed through the hands of the ancient Greeks to Ukraine and left battered by three major wars, Crimea truly is the jewel of many crowns (Newman, 2011). The period between 1 B.C. to 1475 set the stage for what was to become Crimea’s legacy. It was the rich resources offered by the peninsula that first attracted the Greeks in 1 B.C. (â€Å"Crimea,† 2011 ). Crimea soon became an important source of wheat for the kingdom (Rubel, 2003). However, the Greeks were unable to maintain a firm hold on the peninsula and were constantly warding off invaders. It became apparent that Crimea was not to stay in the hands of one group for long, a fact that has been the bane of many empires ever since. First the Goths and then the Huns, Slavs and Mongols following in succession invaded Crimea over the next thousand years (Crimea). Each fought to achieve control over what many deemed as paradise. Misrepresentation in Uk Law

A false statement made to induce a party to enter into a contract. Misprepresentation — if proved — renders a contract voidable (see: VoidableContract). Three (perhaps four) factors must be established to succeed in a claim of mispresentation. (i) there must be an unambiguous false statement of existing fact (or perhaps law); (ii) it must be addressed to the party misled; (iii) it must induce the contract; (iv) (perhaps) it must be material, that is, one which would induce a `reasonable man' to contract in those circumstances. Grounds for misrepresentation (i) There must be an unambiguous statement of existing fact.Since Kleinwort Benson v Lincoln CC (1991) it might be the case that a statement of law may also found a misrepresentation — although that case concerned resitutionary remedies for money paid under a mistake of law, rather than contract. Three classes of statement are generally not held to be representations: (a) `puffs', (b) opinions, and (c) intentio ns. (a) It can be difficult to distinguish a misrepresentation from a `puff', that is, an advertising or promotional statement which is not intended to be binding (Dimmock v Hallett (1866), in which it was representated that land was `fertile and improveable). b) A statement of opinion is not a representation (Bisset v Wilkinson (1927)) unless the opinion of the person making the representation has some special weight, e. g. , he or she is a professional employed to give such opinion (Esso v Mardon (1976)). (c) A statement of intention – if honestly held – cannot be a misrepresentation; however, my intention is a fact and it can be dishonestly represented — Edgington v Fitzmaurice (1885). (ii) The statement must be addressed to the person misled. (iii) The statement must induce the contract.It need not be the sole inducement (Edgington v Fitzmaurice (1885)). This test will fail when (a) the representee is actually unaware of the representation (Horsfall v Thomas (1862)), (b) the representee knows the statement is untrue, and (c) where the representee is patently unaffected by the statement. (c) is likely where the representee takes other steps to establish the validity of the statement (Atwood v Small (1838)). In general, the fact that the false statement could have been discovered with due diligence will not prevent it being concluded hat it induced the contract (RedgraveVHurd1881) but more recently it has been suggested that a misrepresentation does not induce where it would be highly reasonable to expect the representee to check the validity of the statements (SmithVEricSBush1990). (iv) (Perhaps) the statement must be `material', that is, one that would induce the contract in a reasonable man. Currently this criterion is doubted. Modern practice seems to be to incorporate this requirement into consideration of whether the misrepresentation did induce the contract.Types of misrepresentation Fraudulent misrepresentation This overlaps with the TortOfDeceit. The misrepresentation must be intentional and dishonest (DerryVPeek1888). Damages are not limited by remoteness (see CausationInNegligence). Rescission may be awarded. Negligent misrepresentation The misrepresentation was not intended to deceive, but nevertheless the defendant is in breach of a DutyOfCare to the claimant. Rescission may be awarded. Innocent misrepresentation The mispresentation was neither fraudulent nor negligent.In general, damages are not available, but rescission may be awarded. See also MisrepresentationAct1967. Misrepresentation Act (1967) s. 2(1) of this Act is extremely important for claimant seeking compensation for Misrepresentation. It has the effect of shifting the burden of proof from the claimant to the defendant; that is, if the claimant alleges that the defendant made a negligent misrepresentation, the onus is on the defendant to show that he had good grounds for believing the representation to be true.The Act also makes it possibl e for the court to award damages in misrepresentation cases, where Rescission would not be available. Another effect of the Act, or at least of the way the Act has been interpreted by judges, is to allow the claimant to recover not just forseeable losses, but all direct losses. This seems to follow from the wording — the Act says that a misrepresentation should be treated as deceitful, despite there being no dishonesty, unless the defendant can show that he was not negligent.It seem unlikely (to me at least) that the creators of the statute had in mind that damages for negligent misrepresentation should be as extensive as fraudulent misrepresentation, but there are a number of cases that suggest that judges don't see things the same way. rescission To rescind a Contract is to treat it as terminated, perhaps because one party is in breach (see: RepudiationOfContract), or because the contract is voidable (e. g. , for Misrepresentation). voidable contractUnlike a void contract ( see: VoidContract), whose legal status is as if it never existed, a voidable contract is one that remains in force until it is declared void by one of the contracting parties. For example, one of the parties may fraudulently misrepresent a service to be offered. The offended party may then declare the contract void and refuse to be bound by it (see: Contract). However, if goods are exchanged under the contract before it is voided, then title is passed. With a void contract no title passes, because effectively the contract never existed.
